The court ruled the law unconstitutional for giving Amtrak a say in setting the metrics that could lead to penalties. U.S. Circuit Judge Janice Rogers Brown said that was akin to the government giving General Motors Co. (GM) the power to regulate automobile manufacturers.
This is a completely bogus analogy by Judge Brown. A better one would be if Hertz could regulate GM. Amtrak member railroads were releived of there common carrier passenger carrying obligations with the formation of Amtrak. Therefore there was a certain quid pro quo, with railroads being able to eliminate providing passenger service in return for providing a minimum level of on performance for Amtrak trains.
