There hasn't been a single contract signed in ten centuries by any govt, corporation, consumer, or anyone else; that did not impose a performance metric. . . . .

So why should Amtrak have to. If you are going to say that Amtrak has no authority to impose performance metrics on those they contract with - and enforce them with teeth ...
You might as well just declare that Amtrak has no authority to enter into any contract at all.
Without performance metrics, why even bother with contracts. It would be worth less than the rag it is printed on. Either party could then do whatever it wanted, when it wanted, or not at all, irrespective of the contract. They could, and would, just say they did what was required without actually doing it; the it not being defined in any real clarity.
When was the last time your bank (a private entity) -- imposed a late fee on you (another private entity) -- for not meeting the performance metric in your agreement. Did they have to beg the gov't to impose it? NO - because they contractually could, they just took it.
Think of Amtrak as imposing a late fee here. There is no damn difference. That judge is just another freakin' extremist judge that is drunk on his own bias. And the railroads involved here; nothing but spoiled little children throwing a self centered, narcissistic tantrum; just because they were caught not doing their chores.
