Yeah my memory isn't great either...
but, back some years ago a Vermont oriented railroad (Green Mountain?)wanted to abandon a line that wasn't profitable. The problem was that Amtrak used it to service towns in northern Vermont. So, Amtrak pulled the eminent domain argument. Not really an issue, except that a good part of ROW was on leased lands. The Federal court ruled that Amtrak had the right of eminent domain but it would have to negotiate a new lease with each land owner. Apparently, Amtrak thought it was above the need for negotiating land leases.
