1 Killed After Amtrak Train Plows Into Car

NBC news report "borrowed" of another site: LINK

I really hate headlines. Amtrak does 90 mph south of Trestles/San Onofre. They make it sound like the train veered off the tracks onto the freeway and hunted the car down.

Train on track, car/person on track not at a crossing = person/car's fault

Train on track, car/person on track at a crossing = probably person/car's fault (assuming train was following the rules and crossing system, if any, was working properly).

Train no longer on track due to railroad's fault and you get hit off the right of way or a crossing = call your lawyer
