And this is just the hearing on the injunction, which
is in part based on how the judge expects to rule
in the "real" hearing in February. The judge's tenative
ruling indicates the NCRA is in real trouble. They'll have
to do a full environmental review before they can restart the repairs.

And, in February, we'll find out whether the Operating
Lease Agreement and the Loan Agreement pass legal
muster. Without the loan, I can't imagine that Berg-Williams-Bosco
will risk putting more skin in the game.

We're taking bets. How long before the NCRA informs the
public that there is no way freight will be up and running
by the summer of 2008?
