I don't know details of the contract between Wisconsin and Talgo but it would seem logical that if Wisconsin was supposed to pay for them it should let Michigan take over and pay TALGO what Wisconsin owes for the trains so Wisconsin would be off the hook.

Contract issues could theoretically be worked out regardless of where the train sets are stored.
