Non-union operators can do pretty much what they please with their employees, with those whose jobs involve moving the trains being subject to the hours of service law (doesn't include chair car attendants, dining car waiters, cooks, bartenders, etc.). When the employer becomes too rude, capricious, arbitrary, and demanding, the employees start organizing (which is labor relations-speak for "inviting in the union").
