I suspect they can do that if they still own the track and only lease operating rights to somebody. But in SC they sold it outright, and the intent all along was to use it for passenger service - tourist/occasional at first, and someday regular transportation. The state funding they received was from an account that is specifically for preserving lines for passenger service.
