Well, let's see. PATH is under FRA and thus "not a subway" though anyone usig the system would disagree. The SIR--former B&O subsidiary Staten Island Rapid Transit-- is "not a subway" except that it uses cars built for the New York City Subway. So, cut the reporters a little slack, the distinction is mainly bureaucratic.
