Railroad employees are covered by FELA...a form of "no fault workman's comp" where any injury is the railroad's fault no matter what and the railroad will pay dearly through our legal system.
A derailment cleanup contractor on the other hand must be covered by Workman's Compensation Insurance either through a private carrier or the state in which they are headquartered. Same goes for bridge and track construction contractors which is why you see these tasks no longer performed by the railroads.
