I would think liability in this case would depend upon the terms of the Interchange Agreement with the BNSF and how it relates to track maintenance responsibilities.
A very GREY AREA in many cases! If an industry or interchange track parallels or is within 25 feet of a portion of a a track operated at FRA Class I or higher track standards the adjacent track must be maintained at minimum Class I standards. Failure to do so restricts the higher class track to Class I speeds (10/15 mph).
