So SMART could tell the trail people: you come up with the money to pay off the property owners and we'll be glad to let you put in the trail, too.

Ironically, if SMART were to shut down and abandon, the Rails To Trails scheme could make some of the property owners' arguments moot. At this point, it looks like the lawyers would make as much or more out of the lawsuits as the property owners.
