1. She tailgated someone in front of her to avoid paying her fare.
2. I don’t believe her story that she thought it was a free day.
3. She certainly saw other people buying tickets and inserting them in the exit gates.
4. She refused the officers’ lawful order to identify herself.
5. Because she refused lawful orders, the officers took appropriate action.
6. She could/should have followed their lawful orders. If she had done so and stopped resisting at any point, the officers would have stopped.
7. Fare skipping is a big problem on BART
8. The fact that the fare was only $3 is irrelevant. The officers likely had no
way of knowing the amount due at the time of arrest.
8. This entire situation was her fault.
9. She should be charged with fare evasion and resisting arrest.
10. Her lawsuit is a bogus, blatant money grab and should be thrown out of court.
