In practice, everybody dues Amtrak, which then has to negotiate with various others to partially mitigate the bill. Amtrak is liable for whatever happens, not the host railroad, and seldom any 3rd party. Plu8s, a dump truck driver in Missouri, or even the dump truck company if there is one (could be the driver, self-employed), is almost certainly judgement-proof. Yup, Amtrak, deep pocket.
