Here is a Goolge Street view of the gated crossing. Adjacent to the crossing you can see what look like block signals facing away from the crossing. These illuminate a white aspect when the gates are down to an approaching movement. Presumably the plaintiff will argue the LRV should have slowed down until the gate was down and the light was illuminated. This, of course, regardless of the horn and the flashing lights on the gates and stanchion.

If you spin the view around, you can also see the old Washington Baltimore and Annapolis station. the LRV uses part of that old right of way.
