That's not a passenger issue.

Amtrak can sue the freight railroads for that. The contract of carriage between Amtrak and passenger is between Amtrak and passenger. Thus, passenger sues Amtrak and claims damages from Amtrak. Amtrak is the 100% responsible party, to the passenger, for the safe and on-time service. Not the class ones you wanna gang up on.
