No, he survived. At the last minute he jumped out of his vehicle. His defense was that he was trying to commit suicide but changed his mind. He claimed that he tried to flag down the train. Witnesses testified that he stood at the side of the tracks and watched the accident happen. Later there were conflicting reports that he tried to mingle with the injured passengers. He is currently serving 11 concurrent life sentences.
