Wichester Railyard Lawsuit

The Winchester Rail Yard case started Monday morning in Douglas County Circuit Court with jury selection.
One hundred potential jurors were called in and received some specific questions approved by Oregon’s Attorney Generals Office.
The nine page document contained 23 questions ranging from whether they have suffered consequences as a result of being delayed by a train in traffic to how the prospective juror feels about state government.
Twelve jurors will be selected with alternates and the trial is expected to last about three weeks.
The case is being heard in front of Judge Randy Garrison.

The Winchester Rail Yard lawsuit against the State may be settled out of court.
The lawsuit was filed by Central Oregon & Pacific Railroad
to have the $7.7 million dollar ConnectOregon grant reinstated. The State has countersued the railroad to get back more than $1 million dollars that has been spent on the rail yards construction so far.
Oregon Department of Transportation spokesman Patrick Cooney says an out of court settlement between the State and CROP is now in the works.
Cooney added that exact details of the agreement were not released after yesterday’s emergency executive session with the Oregon Transportation Commission.
Details of the agreement will be released to the public after both sides have signed off on the final negotiated settlement agreement.
Potential jurors in the case were told to not come in today, allowing time for both parties in the lawsuit to review the proposed settlement. If both sides do not agree to the proposal then the case will move forward with final jury selection and trial will continue as originally scheduled.
