ODOT Settles Rail Yard Lawsuit
The Winchester Rail Yard lawsuit against the State of Oregon has been settled out of court.
Central Oregon & Pacific Railroad in Roseburg, Oregon had filed a lawsuit against the State of Oregon and the Oregon Transportation Commission for restoration of a $7.7 million dollar ConnectOregon grant to build the rail yard just north of Roseburg.
Potential jurors were called earlier this week for the case just before the State made its settlement offer yesterday.
In a joint press release issued last night, ODOT has agreed to reinstate the grant in the amount of $4,995,458 dollars and to drop their countersuit against CORP.
The railroad also agreed to some additional cost cutting savings that will reduce the original overall cost to build the Winchester Rail Yard.
CORP also agreed in the settlement deal that after ninety days after completion of the Winchester Rail Yard all rail car classification will be moved from downtown Roseburg over to the new yard.
CEO of RailAmerica, John Giles said CORP is pleased to fulfill its promise to the people and shippers in and around Roseburg. He added that completion of the new rail yard will provide relief from traffic tie ups in downtown Roseburg. The new rail yard is expected to be completed by the end of this summer.
