No, the P&W is clearly responsible for the yard track. The April incident was a human factor incident, and the May incident was due to the track... a section of track that has had a few other incidents in recent years.

I'm not sure if this would be likely to get FRA attention or not. It's my impression that, on a national scale, the FRA has bigger fish to chase.
