To clarify Ken's comments, the photos involved were
not owned by the UP. The photos were legally taken/licensed by Nils Huxtable, but UP contended that since they were clearly photos of Union Pacific marked equipment, and the photos were being used in a commercial setting, that a violation of UP's intellectual property rights had occured. UP wanted Nils to pay a license fee for the photos in his calendars.
