No one is "forcing" you to stay 70 feet from the UP's ROW. That is just a benchmark limit established by the railroad to keep rail fans under a bit of control. Obviously, the RR knows its fan base, and the extent the fan base will go to to get that great picture.

Well, no. If you or the public (ie surfers at a public beach) own a piece of land that abuts the RR ROW you have full access to your/the public property.

In this case it must be assumed that the performers were in fact trespassing.
The 70 foot rule's sole purpose is to rein in the zealous railfan in his quest for the perfect picture.
