July 3, 2006 Cowlitz County crossing fatalities inquiry

Reading the string of replies about the "Ghost Train" crossing fatalities in Missouri got to me thinking about the crossing accident near Castle Rock, WA on July 3, 2006 where 4 were killed when the car pulled out into the path of a sounthbound Talgo after a northbound freight had cleared the crossing on the first of two tracks. This occurred on a private crossing after the end of a county road and a suit was filed wanting the railroad or county to pay damages because the crossing not being better protected. Does anyone recall how this came out? I was able to Google enough information to get the date of the accident, but could not find any outcome of the case. I was working out of the area by June 2007 for a period of time and never saw any more on the case.
