Can't specifically comment on this case but was talking to a carrier the other day where a substantial fine fine levied by the Department of Labor for harassing employees with operations testing. DOL wasn't intersted in the carrier's explanation that operations testing is explicetly requiredc by FRA in Part 217 for certain employees. The case subsequently went to court and was reversed.
