Ummm ... what about the FL9 as prior art?

These things are hardly revoluntionary, and the first few have even been in service for a while. Up to date and computerized, perhaps. More power on diesel and electric than the older stuff, perhaps. Running off overhead AC rather than 3rd rail DC, perhaps (which means they're hauling around a big transformer whether they're using it or not). Simply new (not beat up with millions of miles on them), definitely. NOT a new invention! I'm sure they cost NJT a bundle, though.
