This accident would have been far less likely to have occurred if the rules contained in CFR Title 49, Part 214, "Roadway Worker Protection" had been followed. These are the FRA-mandated worker safety protection practices which apply to all railroads under FRA jurisdiction. Under Part 214, the situation at BARTD would have come under "Train Coordination", and required a lookout be assigned by the Employee-in-Charge (EIC). That lookout has the sole purpose of watching and listening for train activity and warning track workers to clear the track within a prescribed time before the train enters the work limits. All freight, passenger and excursion railroads under FRA jurisdiction fall under Part 214 operation rules, and many have adopted even more stringent operating rules. It is incomprehensible to me that ANY public rail line could or would operate outside of Part 214. These rules are written in the blood of workers who died for lack of effective operating rules, so that the kind of mishap at BARTD would never happen again!
