Actually, the Chinese will probably be stuck paying for the complete repair of these locomotives and any liabilities associated with their operation over the past 2-3 years.
The People's Republic of China is now a member of the WTO (World Trade Organization) and is subject to all binding terms of that membership. One of those is sales between two governments via state owned/operated companies. Since DLoco (Dalian) and KiwiRail are both state owned/funded, the Chinese will have to pay or face potential WTO sanctions.
Since China is seriously trying to break into the locomotive export market, it is in their best interests to show that they will repair/replace any defective or unsafe product.
As a one-time resident of the PRC and long-time visitor, I personally wish that they would stop exporting diesels and resume exporting 2-8-2's but that will never happen.
