Nothing nefarious here. Apparently NCRA is suing to force Novato to be compliant with a court order issued in Novato's own lawsuit against NCRA. It looks like the city of Novato missed the deadline to produce documents.

It would be proper for NCRA's lawsuit to be filed before the same judge as in the city's lawsuit because he is also the judge who would have issued the original order that Novato is apparently not in compliance with.
