Well-spiked rail tends to hold the gauge, so likelihood is kink will start in one rail and the other rail follows. This is a lateral kink, displacing ties where ballast resistance to lateral movement is weakest within the zone of highest stress in the rail. Weakest point + highest stress = starting point for failure.
