Is anyone paying attention to the lawsuit?
If the judge holds his TRO and defines the "whole of the project" as restarting freight to Eureka, Mitch Stogner has said it'll be 4-5 years before they complete the process. The money they've gotten from NCRA won't matter, because they won't be allowed to spend it until the full EIR is complete and no one has said who would fund such a study. (John Williams where are you when we need you?)
The NCRA has violated the law. Hemphill is merely trying to get press while the NCRA boat is sinking.
