Red flashing lights that govern vehicle traffic usually only require that the motorist come to a complete stop, then proceed when it is safe to do so. Think of an intersection governed by stop signs that has a flashing red light above it. ( Of course this does NOT apply to a school bus situation. ) There are many railroad crossings governed only by flashing red lights and NO crossing gates. In most states it is perfectly legal to treat the crossing as I have described above, provided the motorist STOPS FIRST and looks both ways before crossing the tracks. Maybe not SMART, but still legal...
