I really don't understand why Commuter and some of you are always out for financial revenge against the relatives of people who cause grade crossing accidents that don't personally inconvenience you. You don't have to be a lawyer to know that family members who aren't in the car have no liablity or financial responsiblity for the actions of the driver unless it can be proven that they contributed to the negligence by knowingly allowing the person to drive under the influence of alcohol or drugs or did something else really stupid.
I don't encourage frivolus lawsuits by people trying to avoid responsiblity for their own stupidity but since we don't seem to know the cause of the accident it's possible that grade crossing signals malfunctioned or there was poor visblity at the crossing that could have been a contributing factor.
Unless the deceased was wealthy there probably isn't enough assets in the estate to recover all of the expenses incurred by UP and Amtrak. Their lawyers aren't likely to waste their time and money to try and take the home of a widow or widower and surviving children.
Why don't you contribute to Operation Lifesaver and spend your time working to improve grade crossing safety instead of starting these tirades?
