I think that "indiscriminately" is an editorial reference to that "evil train", which would be acting like one of them "evil gubmint's" that would use the condemnation process for public purposes, which would require that they pay private property owners the fair market value, under the due process of law, after a legal hearing and finding, when taking private property for public purposes, even for a publicly regulated utility, like for that danged "evil train".
It's like how they use that phrase to describe the "indiscriminate" bombing of civilians, or the "indiscriminate" shooting of hostages.... It's a word being used to get folks riled up about them evil train folks, doing that "indiscriminate" evil killer train, which will do "indiscriminate" evil to the poor property owners of Texas.....
So maybe that's just a little "editorial license" pandering to the anti rail hysteria, over this vast "evil" conspiracy, by that danged "evil gubmint" and that stupid "rule of law".......to build necessary public and/or private infrastructure that allows us to live with stupid things like modern highways, electricity, running water, flushing toilets....or even high speed rail lines, that may require public rights of way to allow all of us to benefit, "indiscriminately"....from the existence of such complex systems.
