Just because someone drives like an A-hole hardly implies they are addicted to anything. It only means they are an A-hole! And last I checked, that is not even a misdemeanor. In our office we see this sort of thing all the time; where someone doing some A-hole driving causes an accident hurting one of our clients, but with no actual impairment involved - just A-hole driving.
If he did commit traffic infractions, he should have been cited for them - and nothing more. And certainly, if both his breathalizer and blood tests came back negative for alcohol or any other drug known to impair anyone (as was the case here), DUI charges should never have been filed in the first place.
Unless they can show that the standard signs of physical or mental impairment were actually observed, the P.C. to even administer the test is questionable. Moreover, given that impairment by caffeine is an unheard of and unprecedented charge, it will be very difficult to prove. So unless the media left some very big factors out of the story (not unusual) - he will clean California's clocks in a civil false arrest lawsuit.
And if he takes out a rogue prosecutor while at it - then so much the better for all of us.
