Can the Donald really just use his magical golden pen to magically repeal laws passed by Congress with executive orders?
I ask, because the last time I checked, PTC and many other rail safety regulations are mandated in the rail safety bills that have been enacted by Congress, and are codified in public law.
I also ask, because the last time I checked our Constitution, I seem to recall that it is Congress that makes those laws, not the President. And, it is my experience, after many years of reading those stupid boring RR regulations in the Federal Register, that most Federal regulations are promulgated because these are specifically called for in the legislation, in order to enforce these acts of law, passed by Congress and signed into law by the President.
So unless Congress changes those laws, that Trump purportedly took an oath to enforce, they are in effect, and the Donald cannot just arbitrarily change them at his whim.
The repeal of rail safety regulations mandated by Congress will require Congress to change the laws which called for those regulations to be implemented. Maybe, if you really hate rail safety regulations, you can talk Congress into rescinding requirements for degassing explosive fracking oils?
