Sure it was a smart move on Metrolink's part and doing so ahead of time put it right up in front. Even if they hadn't Connex would have been named as a third party anyway. This just keeps them from trying to wiggle out of it for five years. This raises my question. How could AMTRAK have avoided liability if they had signed the contract without that clause and had been the operator at the time of the accident? I know they didn't but just suppose they did. Wouldn't they have been liable if one of their operators was running the train anyway?
