I agree it's a big lawsuit waiting to happen. Why does the operating railroad allow dangerous conditions to exist on the ROW? Someone is far more likely to get hurt breaking a leg (or worse) walking along at night with a hole in the walkway than someone (good deeds) replacing a plank and putting up caution tape.
