As Bob2 has pointed out, it's perfectly legal to photograph anything anytime provided you are doing so from public property, such as the highway running along side the track. What these freeloaders aren't at liberty to do is enter onto private land to do so without the landowner's permission. Undoubtedly those who paid for the charter resent the fact that this permits photography by those who haven't paid, but that's the way it goes.
