Well let's see now, the basic design of traction motors wss more or less perfected by GE and WH before 1915.
EMD's control system (actually EMC's) was designed by GE in the 1920s (the Lemp system, which was also used by Alco and GE).
Siemens came up with the solid-state inverter/frequency control for 3 phase traction motors.
More than likely all the basic patents on the Winton engine, both superhcharged and turbocharged, have expired.

Copyrights are held on media (books, magazines, songs, etc.), not machinery and other such devices. EMD (whoever owns it this month) probably retains service mark rights to the EMD emblems, logos, etc. The mere letters E M and D cannot be serviced marked, but the artistry of their presentation can.
