Suing the Board is a very difficult process, deliberatly made this way when the RLA was enacted in order to keep these types of lawsuits from tieing up the courts in a big way, which they were. About the only thing the Board can be sued for is malfeasance.

I skimmed through that newstribune article, and as usual, the media have the situation all muddled.
