They weren't on the list but were killed anyway, and as part of the EPA settlement. Proof was required the deed was done, not just someone saying so. These were substitutions for others on the list not scrapped. At the end of the day the EPA doesn't care what is killed, just the final tally agreed to in the settlement. I'd say at least a quarter of the original list isn't even valid now.
