As a cyclist, I see the people suing as stupid. The lawsuit should be thrown out. With that being said, all routes are open to cyclists and all have some sort of hazard - most of the time it is a motorist that doesn't know how to deal with a cyclist properly. I've ridden over streetcar tracks plenty of times, never had an issue. You just need to be careful.
