Please cite the governing title of the CFR (Title 49 section 236 subpart B - "Automatic Block Signal Systems") which prohibits either of these; or any other authorities which will substantiate these assertions.

Maybe you will find it in the A.A.R. Signal section or A.R.E.M.A. standards and recommended practices. But remember, those have no force of law. They represent only "Industry Standard Practices" and are not binding. Very important - but nevertheless not the law; neither does the F.R.A. enforce them.
