Apparently, the NIMBYs may have part of the blame as the gates and lights were working, and the train passed before the girl enter the crossing. However, due to the way in which the sound walls were installed she could not see approaching trains from the opposite direction, so she thought that the train activating the crossing had past.
If the sheriff is correct then, the UTA, and the MINBYs are responsible as they forced the construction of an unsafe crossing.
Realtors try their best to sell houses, but folks as still dense. My friend (a realtor)sold a house in Fremont that backed up to the then WP mainline. They disclosed that one or two trains a day operated behind the house, the property sold and 6 months later UP purchases WP. The new owner tried to sue everyone, both RRs, the Realtors, the city and previous owner as the train volume increased to 5 trains a day.
These folks do not care if someone dies because of their demands for sound protection. In there mind they have no shred of responsibility or accountability since it did not happen in my yard.
