Discontinuance of use is equivalent to removal in the FRA's eyes. See 49 U.S.C. 20502(a).

Your comment that ATS is "not really being used" is incorrect. ATS can be used at any speed. The fact the maximum track speed was downgraded from 90 MPH to 79 MPH or slower makes no difference whatsoever.
