Attorneys for City of Novato have filed a ludicrous, ridiculous and misleading WRIT OF MANDAMUS against North Coast Railroad Authority under the thin veil of environmental concerns. I have read all 31 pages of the petition and you do not have to be an attorney to understand it. The lawyers went on your basic fishing expedition at the NCRA offices in Ukiah to find anything that a Judge might rule on however they would have had better luck in the nearby Russian River! The real reason to stop Interstate Commerce is the noise from the whistles from the locomotives. This has nothing to do with whether the NCRA has made any of the alleged violations of the Brown Act or failing to provide an EIR that clearly IS not needed. The NCRA was already been granted a Categorical Exemption under CEQA (The California Environmental Quality Act)for work on the Russian River Division for repair of the railroad. All the work will be and is being preformed within the existing right of way. There is little logic here to work with. The steel wheel on the steel rail is the most efficient way to move freight. Instead of lumber, sand, gravel, rock, solid waste and agricultural products moving historically by train, the City of Novato would have you believe that the best way for this traffic to move through Novato is on an already ba1dlly congested 101 on noisier and polluting trucks.
