In a grade crossing accident, the train crew is NEVER tested.
As far as the trucker goes, it really makes you wonder, was he talking on a cell phone, was he text messaging, under the influence or a combination thereof? Kind of hard to miss flashing red lights and gates up ahead and for that matter, a big train that is a hell of alot bigger than you are.
Just my 2 cents worth.
