Generally, COMPANY ISSUED cellphones or other electronic devices are not considered a distraction in the workplace if they're being used for company business.
Anyone ridden Amtrak lately? Have you had your ticket scanned by the conductor's iphone? Did he have to bring the train to a stop before he could scan your ticket? Why not? Hmmmm.
It's not considered a distraction for him/her because the iphone is company-issued.
Yes. Yes. I know. It's ridiculous. A freight conductor could be on his company issued cellphone, arguing with a clerk or a customer over how a freight car should be spotted, but that will not be considered a distraction because it's on a company cellphone and discussing company business. However, if he's on his PERSONAL cell phone and discussing with his wife about how she's been spotting her car on the driveway, that IS considered a distraction and he could be terminated.
You can't make this stuff up. You have to leave it in the hands of a Government bureaucracy in Washington to dream up stuff like this.
