I've seen a lot of Real Railroad (non-main) lines that are in pretty dicey shape, as well as not a few transit lines where maintenance deferral is pretty obvious. A museum or tourist train that's always strapped for cash will most likely leave the non-glamorous track work until the need becomes obvious == they can't run any more. If somebody else owns the tracks and the museum is a tenant, it's not surprising that the owner might be unhappy with obvious deterioration and lack of income.
What's FRA's jurisdiction over track condition on museum/tourist/amusement park lines that don't connect with the RR network? This doesn't apply for FW of course - they are connected.
