I have a friend who used to be an accident investigator (not for NTSB). He told me that the NTSB always wants the accident site preserved but they are the first to admit it is not always possible. First responders have to do their jobs and public safety must also be considered.

He also asked if the driver was killed. I don't recall that. A fatality generally requires that the scene be preserved to a higher standard. Even if the driver was killed its still a good bet that the lawyer is grasping at straws.
